Nicotine Pouch Marketing Rules: FDA Limits and Claims

Nicotine pouch marketing is limited by FDA marketing orders, claim restrictions and platform bans on nicotine ads. FDA authorized the first pouches, 20 ZYN products, on January 16, 2025, with restrictions on digital, TV and radio advertising, and it says authorization does not mean a product is safe or FDA approved. This guide covers what pouch brands can say and where, checked October 6, 2026.

This guide is communications research, not legal advice. Each FDA order is specific to named products, so check the order that covers your product.

What did FDA authorize for nicotine pouches?

FDA authorized 20 ZYN nicotine pouch products through the premarket tobacco product application pathway on January 16, 2025, the first time it had authorized nicotine pouches. The products come in 3 mg and 6 mg strengths and 10 flavors, and the authorization is specific to those products. FDA's announcement says the order does not mean the products are safe or "FDA approved," and it reviewed youth data before authorizing them. The 2024 National Youth Tobacco Survey found 1.8 percent of U.S. middle and high school students reported currently using nicotine pouches, according to the agency.

One trade tracker reports that FDA has authorized 43 nicotine pouch products as of September 1, 2026, including on! PLUS products decided in December 2025. EPR could not confirm that count against FDA's own list, so check the current list before promoting any pouch as authorized.

What marketing restrictions did FDA attach?

FDA attached stringent marketing restrictions to reduce youth exposure to pouch advertising. They cover digital, TV and radio, and the measures described include no mass-market advertising on radio and TV and using actors or models no younger than 35. FDA also barred any express or implied statement of FDA approval on labels, labeling, media or advertising, and it barred modified risk claims unless FDA issues a modified risk order, as law firm summaries of the order note.

Treat those terms as a template. Expect an order for any authorized pouch to include marketing conditions, and read it before building a campaign.

Can nicotine pouch brands make reduced-risk claims?

Brands can make a reduced-risk claim only if FDA has issued a modified risk order for that product and claim. In 2026, FDA issued modified risk granted orders to Swedish Match for 20 ZYN products, allowing marketing with a claim that switching completely from cigarettes lowers the risk of several smoking-related diseases. FDA and the World Health Organization emphasized that no tobacco product is safe and that quitting all tobacco is the healthiest option.

The order applies to those specific products and that specific claim. A competitor cannot borrow it.

Can you advertise nicotine pouches on social platforms?

Major platforms bar nicotine ads, which leaves little paid reach. EPR read these policies on October 6, 2026.

What should nicotine pouch communications teams do?

Nicotine pouch brands should plan for owned channels, retail and earned media, and for compliance review of every claim. EPR's guidance:

  • Confirm the exact product and flavor appears in an FDA marketing order before promoting it.
  • Never say or imply "FDA approved," and never describe a product as safe.
  • Use reduced-risk language only if a modified risk order covers it, and use the order's wording.
  • Age-gate owned channels, and avoid imagery, talent or media that appeals to anyone under 21.
  • Check the order's marketing terms for digital, TV and radio limits before buying media.

Frequently Asked Questions

Is it legal to advertise nicotine pouches?

Authorized pouches can be marketed within the terms of FDA's marketing order, including restrictions on digital, TV and radio advertising. Pouches without an FDA marketing order are not authorized.

What was the first nicotine pouch FDA authorized?

FDA authorized 20 ZYN products on January 16, 2025, the first nicotine pouches it had authorized.

Can pouch ads say the product is safer than cigarettes?

Only with a modified risk order for that product and claim. FDA issued such orders for 20 ZYN products in 2026, and the claim must follow the order's wording.

Can you advertise nicotine pouches on Facebook or Instagram?

No. Meta's Advertising Standards bar ads that promote the sale or use of tobacco or nicotine products and related paraphernalia. Last verified October 6, 2026. FDA's ZYN announcement and the Meta, Pinterest, Google and Snap policies were read directly. The 43-product pouch count and the modified risk order details come from secondary coverage.
