Scope: Media campaigns

* Create a multimedia marketing campaign that uses multiple media types to reach an intended audience, applies marketing techniques that influence behavior of an audience, uses branding, and uses various communication efforts that are researched, developed, evaluated, and appropriate for the target audiences, and meets campaign goals; campaign materials shall be accessible in federal guidelines.
* Create campaign materials in English and Spanish.
* Use a DHHS approved translation and interpretation company.
* Pre-test or evaluate campaign messaging with DHHS defined audiences.
* Submit pre-testing or evaluation results no later than 30 days after completion of the pre-testing or evaluation.
* Conduct audience research to develop advertising and messaging, implementation strategies, and distribution channels either in-house or through a subcontractor.
* Evaluate the effectiveness of the campaign in reaching the intended audiences and changes in the intended audiences’ knowledge, attitudes, and behaviors.
* Update, reuse, and re-tag existing TV, radio, print, and other ads.
* Place closed or open captions on all TV spots and videos.
* Use best practices and evidence-based prevention strategies to inform the campaign.

* Avoid duplication of activities and services with other Contractor and DHHS contracts.

Public relations

* Not be listed as a sponsor for events.
* Create and submit a public relations plan for media, community, and grassroots marketing efforts upon request.
* Attend scheduled media interviews upon request.
* Plan or attend campaign events upon request.
* Develop messaging toolkits and talking points upon request.

Website

* Host the website on the state of Utah hosting environment unless otherwise approved in writing by DHHS and DTS.
* Not maintain any domain registrations on behalf of DHHS.
* Create a campaign website to comply with DHHS and Utah.gov privacy policies.
* Ensure all websites and materials are 508 compliant.
* Ensure all websites comply with the Web Content Accessibility Guidelines 2.1 AA rating.
* Comply with Utah Design System.
* Adjust user interface, functionality, and site navigation until it meets the established requirements of DHHS and the Utah Department of Technology Services.
* Update content and design on the website upon request.
* Conduct accessibility checks using the Utah Design System every 6 months or upon request.
* Provide training on how to maintain and update the website upon request.

Licensing, sale, and distribution of creative works.

* The Contractor may market the works to out-of-state markets during the term of this contract upon written approval from the DHHS Office of Public Affairs and Education:
* the Contractor shall cease marketing the materials upon request;the Contractor shall provide DHHS a draft and executed copy of each licensing agreement and obtain written approval before entering into any licensing agreement on behalf of DHHS;the Contractor shall mail licensing fee payments to DHHS; andDHHS agrees to pay the Contractor 40% of the Net Proceeds from licensing the works to out-of-state parties as a marketing commission.
* If DHHS markets the works to out-of-state parties:
* the Contractor shall have the first right of refusal to modify the works to meet the out-of-state party’s needs; andpay the Contractor 25% of the Net Proceeds from licensing the works to out-of-state parties.

* No later than 30 days after the licensing agreement is executed, the party that marketed the package to an out-of-state party shall produce an accounting of the sale to the other party. The accounting must detail each cost associated with the sale and production of the works. The party making the sale shall also provide the third party with a copy of the accounting. DHHS shall calculate commissions and Net Proceeds and issue the Contractor payment within a reasonable period after production of the accounting required in this paragraph.
* Marketing commissions and the Contractor’s share of the Net Proceeds, including residuals from ongoing licensing agreements with third parties, terminate at the termination of this contract.
* The Contractor is restricted from submitting invoices for time and effort expended on out-of-state sales.
* The Contractor shall not collect a commission from any third party when the material was paid by DHHS.
* The Contractor shall remove all DHHS branding in all sale or licensing of the works.

Reporting

* Submit proof of performance reports and material as evidence of the media buys with the invoice or upon request.
* Submit a line-item description of all paid media, matches acquired, and the total number of spots aired upon request.
* Submit a written summary no later than 48 hours after each DHHS meeting including discussions, action items, and approval requests.
* Submit progress reports demonstrating work completed and progress made on the campaign, upon request.
* Submit an annual report on the progress of the campaign on or before September 1 each year of the contract.
* Submit a report no later than September 1, 2030 that describes:
* the implementation of the Youth Marijuana Prevention campaign;the results of the Youth Marijuana Prevention campaign; andrecommendations for the continuance or the suspension of the Youth Marijuana Prevention campaign.

Invoicing

* Submit invoices in DHHS format to myrodriguez@utah.gov.
* Include the following:
* a detailed description of the services;dates services rendered;contract number;uniquely identifiable invoice number;contractor name; contractor’s address for payment;contractor’s phone number;contractor’s signature; andexpenses incurred as indicated by the line items in the attached budget.

Conflict of interest

* Absence of marijuana marketing:
* The Contractor agrees that, during the period of this contract, it will not provide professional assistance or services to companies or individuals promoting marijuana products or their use.“Marijuana products” include any product made from or derived from the cannabis sativa plant. Electronic cigarettes with CBD oil or other chemicals from the cannabis sativa plant and similar products are deemed marijuana products under this contract. CBD means cannabidiol. Medical cannabis products sold by Utah-licensed medical cannabis pharmacies are not considered marijuana products under this contract.
* Brand name sponsorships:
* The Contractor agrees that it will not promote or participate in marijuana industry brand name sponsorships as defined below:
* “Brand name” means a brand name (alone or in conjunction with any other word), trademark, logo, symbol, motto, selling message, recognizable pattern of colors, or any other product identification identical or similar to, or identifiable with, those used for any brand of marijuana products.
* “Brand name sponsorship” means an athletic, musical, artistic, or other social or cultural event as to which payment is made (or other consideration is provided) in exchange for use of a brand name or names (1) as part of the name of the event or (2) to identify, advertise, or promote such event or an entrant, participant or team in such event in any other way.
* Involvement in pro-marijuana activities: The Contractor agrees that during the course of this contract it will not engage in any professional services, in Utah or elsewhere, that could be considered pro-marijuana activities. Pro-marijuana activities include but are not limited to: assistance with any efforts to market marijuana products; lower the price of marijuana products; increase the number of locations where marijuana products are sold; or assist in efforts to prevent the adoption of, or otherwise interfere with, the adoption of marijuana legislation. Professional services include, but are not limited to: advertising promotions, lobbying, consulting, strategic planning, public relations, marketing, or any other professional activity that supports such activities. The Contractor shall request in advance, by at least two weeks, a determination by DHHS of whether any particular activity would be considered a pro-marijuana activity, and Contractor shall not engage in such activity without obtaining permission in writing from DHHS. This prohibition will be recognized throughout the Contractor’s entire company. The Contractor is prohibited from contracting with third parties to carry out pro-marijuana activities on its behalf. If DHHS determines the Contractor is engaging in pro-marijuana activities, but which are not expressly defined herein as pro-marijuana activities, it shall inform the Contractor and provide the Contractor an opportunity to cease such activity.
* No marijuana industry relationships: The Contractor warrants that the Contractor does not knowingly represent or receive payment from any marijuana product manufacturer or wholesaler, or any parent, affiliate or subsidiary of a marijuana product manufacturer or wholesaler or an interest group or advocacy organization, that represents the interests of the marijuana industry and will not do so during the term of this contract. The Contractor also agrees to notify DHHS immediately if the Contractor discovers that it currently represents such an entity. DHHS shall afford the Contractor the opportunity to cease such representation before terminating this agreement immediately without penalty. Should the Contractor knowingly fail to notify DHHS of any recent or existing business relationship with any entity that is part of, or affiliated with, the marijuana industry or represents its interests, or if the Contractor enters into an agreement to undertake any work for or representing any member of the marijuana industry or any related entity during the term of this agreement, the Contractor agrees that DHHS may terminate this agreement immediately, without penalty.
* Relationship of the Contractor’s clients to this contract: DHHS acknowledges that the Contractor represents numerous clients with diverse interests and agrees that the Contractor’s representation or activities on behalf of clients, in and of itself, does not constitute activity in violation of this section or the terms of this contract. The limitations of this contract do not prohibit the Contractor from providing services to clients which may engage in pro-marijuana activity without assistance from the Contractor.
* Failure to comply: If the Contractor is found to violate any of the provisions outlined in this section, the contract may be terminated at the discretion of DHHS and the Contractor shall be disqualified from receiving funds under this funding source in any subsequent fiscal year and no funds beyond those already approved will be forthcoming.

Performance measures

* Collect metrics based on media and marketing industry standards including click through rates, website visits or downloads, impressions, engagements, average engagement rate, audio completion rate, video completion rate, conversions, reach, and frequency.

* Engage parents, the general public, community partners, and DHHS staff in audience research to inform messaging, material development, and campaign strategy. Audience research methods and questions must be approved by DHHS before research is conducted. The Contractor may do this work in-house or contract with a third-party.

* Work with DHHS-approved third-party evaluators to conduct a telephone or online survey with a minimum of 400 Utah households that contain youth aged 12-17 years to establish a baseline measure of knowledge, attitudes, and intended behaviors among the campaign target audiences within 120 days of the contract effective date. The survey—including the survey instrument, methodology, and questions—must be approved by DHHS before it is given.

* Work with DHHS-approved third-party evaluators to conduct a telephone or online survey with a minimum of 400 Utah households that contain youth aged 12-17 years to measure changes in knowledge, attitudes, and intended behaviors among the campaign target audiences in years 2 through 5 of the contract, pending available funding. The survey—including the survey instrument, methodology, and questions—must be approved by DHHS before it is given.
