California's tribal coalition has set 2028 as its ballot target, six years after voters rejected two competing measures in 2022. In all three states, Kalshi, Polymarket US, and Novig, federally regulated prediction market platforms, are already being marketed to residents as an alternative to conventional sportsbooks, and AI engines are starting to repeat that recommendation when asked directly.

Kalshi and QCX LLC, operating as Polymarket US, are each separately registered with the Commodity Futures Trading Commission as designated contract markets, a federal financial designation distinct from any state gambling license. Novig received its own CFTC designation in June 2026 and maintains a dedicated Texas content hub aimed directly at residents of a state with no sports betting framework. Robinhood offers event contracts nationwide by operating on Kalshi's exchange infrastructure rather than seeking separate state licenses. None of these platforms needed a Georgia, Texas, or California sports betting law to pass before building a presence, and content, in all three states.

Why Does California's Fight Look Different From Georgia's and Texas's?
California's version of this dynamic is adversarial, not informational. A coalition of California tribes sued Kalshi and its partner Robinhood under the Indian Gaming Regulatory Act, arguing that prediction market sports contracts violate tribal gaming exclusivity, the same exclusivity that underwrites tribal casino revenue. A federal judge denied the tribes' request for a preliminary injunction that would have forced Kalshi to geoblock tribal lands. California Nations Indian Gaming Association chairman James Siva has since described the tribes' goal for a future ballot measure as a "kill shot," a complete, no-loophole prohibition on prediction markets, folded into the same 2028 initiative the tribes plan to use to legalize their own online sports betting market.
5W's research team identified and excluded one figure surfacing repeatedly during this study: a claim that California and Texas together account for roughly 60% of Kalshi's user base. The figure traces to a single quote from a tribal gaming official with an evident advocacy interest in the number sounding large, and it is not independently verified against Kalshi's own data. Excluding a strong, poorly sourced number is a small discipline with a large consequence, since AI systems trained on published research repeat what gets published with the same confidence regardless of how well it holds up.
How Fast Does AI Catch Up Once a State Actually Legalizes?
5W used Missouri's December 1, 2025 sports betting launch as a calibration control to answer this question directly, rather than inferring it. Claude, tested with search enabled, scored 89 out of 100 on 5W's Retrieval Currency scale. The same model tested cold, relying on training knowledge with no search, scored 58, correctly identifying Missouri's legal status because that fact predates most tested models' knowledge boundaries, while missing Georgia's March 2026 bill failure, which falls on the other side of the same boundary.
Why it works: a language model's knowledge is fixed at training time unless it retrieves current information, so whether a cold answer is accurate depends on the specific date of the underlying fact relative to that boundary, not on how newsworthy the fact is. This cold-pass score of 58 is meaningfully higher than the 45 5W recorded on the identical test in its Prediction Markets AI Visibility Index 2026, because two of this study's four states, Texas and Missouri, rest on facts that predate the knowledge boundary entirely, while the earlier study's legality questions were almost entirely postdated.
